Terms of service

1. Acceptance of terms

By accessing or using Moneycast (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these Terms; we will notify you via the email associated with your account and, for material changes, require re-acceptance.

2. Nature of the Service — not investment advice

Moneycast is a research and informational tool. The content produced — including trading theses, analyses, signals, and recommendations — is generated by software for informational and educational purposes only. It does not constitute investment, financial, tax, or legal advice and is not a recommendation to buy, sell, or hold any security.

Moneycast is not a registered investment adviser under the Investment Advisers Act of 1940, not a broker-dealer, and not a fiduciary. The Service does not consider your specific investment objectives, financial situation, risk tolerance, existing holdings, or tax situation. Before making any investment decision, consult a qualified, licensed financial professional.

3. Risk of loss

All investments carry risk, including the possible loss of principal. Past performance does not guarantee future results. Artificial-intelligence-generated analysis can be wrong, incomplete, hallucinated, or miscited. Market conditions change rapidly; information may be stale by the time you act on it. You are solely responsible for your own investment decisions and for verifying any output before relying on it.

4. No advisory relationship

Use of the Service does not create an adviser-client, fiduciary, broker-dealer, or similar relationship between you and Moneycast. All output is impersonal, meaning it is not tailored to any single user's specific circumstances. Two users viewing the same ticker at the same time will see the same output.

5. No execution

Moneycast does not execute trades, hold custody of your funds, or have discretionary authority over any account. Any action based on Moneycast output is taken solely by you through your own brokerage account.

6. Accounts, plans, and billing

Paid plans are billed monthly or annually via Stripe. All fees are in U.S. dollars and non-refundable except as required by applicable law. You authorize recurring charges on the payment method you provide until you cancel. Cancellation takes effect at the end of the current billing period; you retain access until then. Free-tier usage is subject to rate limits described on the pricing page.

7. Acceptable use

You agree not to:

  • Reverse-engineer, decompile, or attempt to derive the source code of the Service.
  • Abuse rate limits or submit automated traffic designed to degrade the Service.
  • Use Moneycast output to deceive, manipulate, or defraud other market participants.
  • Redistribute or resell output as your own research without written permission.
  • Use the Service to violate any applicable securities law, sanctions regime, or other law.
  • Share credentials or API keys outside your organization.

We may suspend or terminate accounts that violate these terms, without refund for the then-current period.

8. Intellectual property

The Service, including all text, models, code, branding, and documentation, is the property of Moneycast or its licensors. You retain ownership of any inputs you submit. Outputs generated from your inputs are licensed to you for internal use subject to these Terms; they may not be redistributed as standalone product without written permission.

9. No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUT IS ACCURATE, COMPLETE, TIMELY, OR FREE FROM ERROR. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONEYCAST DISCLAIMS ALL SUCH WARRANTIES.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONEYCAST'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MONEYCAST IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100). IN NO EVENT SHALL MONEYCAST BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR INVESTMENT LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to defend, indemnify, and hold harmless Moneycast from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any applicable law.

12. Arbitration; class-action waiver

Any dispute arising out of or related to the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in [TO BE FINALIZED]. You and Moneycast each waive the right to a jury trial and the right to participate in a class action. This section survives termination.

13. Governing law

These Terms are governed by the laws of the State of [TO BE FINALIZED], without regard to conflict-of-law principles. Subject to the arbitration clause above, any court proceeding shall be brought exclusively in that state.

14. Termination

You may close your account at any time from the billing dashboard. We may terminate or suspend the Service or your account for breach of these Terms, risk to the Service, or requirement of applicable law. Sections 2, 3, 9, 10, 11, 12, and 13 survive termination.
